1. CONTEST DESCRIPTION The Jimmy John’s “Freaky Fast Kevin Harvick Delivery” contest (“Contest”) is an online contest that asks entrants to visit www.jimmyjohns.com/kevin to enter for the chance to win: a Freaky Fast delivery of Jimmy John’s sandwiches by Kevin Harvick, one hour meet and greet at the winning company’s location with Kevin Harvick, 50 autographed pictures, 50 Jimmy John’s hats and t-shirts, and 2 tickets to a NASCAR race at Gateway International Raceway. Entrants must provide a photo, from their work place along with a caption (no more than 140 characters) expressing their enjoyment of Jimmy Johns and NASCAR. Contest is open only to legal U.S. residents who are 18 years of age or older at time of entry and who are employees of a business in the St. Louis, MO area which employs at least ten people. The Contest begins on 6/8/09 at 12:01 AM Central Time and ends on 7/10/09 at 11:59 PM Central Time. HOW TO ENTER: Go to www.jimmyjohns.com/kevin and follow the instructions to enter. One entry per e-mail address, per company. After you have filled in the required information, in 140 characters or less give us the caption for your picture expressing your enjoyment of Jimmy John’s sandwiches and NASCAR. You will be asked to upload a photo from your workplace. The picture must be no larger than 4” X 6” in color or black and white. Incomplete entries will be voided. Sponsor is not responsible for technical difficulties related to online entries. Entries received after 7/10/09 at 11:59 PM CT will not be honored. Should multiple users of the same e-mail account enter the Contest and a dispute arises regarding the identity of the entrant, the authorized subscriber of the e-mail account, at the time of entry, will be considered the entrant. The definition of an account subscriber is the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization, which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Any use of robotic, automatic, programmed or like means to enter the Contest online will void all such online entries affected by such methods. Sponsor and its agencies are not responsible for unauthorized human intervention, phone, technical, network, electronic, computer, hardware or software failures, malfunctions or disconnects of any kind, or misdirected, illegible, incomplete, stolen, garbled, fragmented or delayed internet/e-mail computer transmissions or network/ISP/website internet accessibility/availability; or for incorrect or incomplete capture of any information. 2. WINNER SELECTION All entries, must be posted on the web site by 7/10/09 at 11:59 PM CT. On or about 7/13/09, a winner, will be selected by a panel of independent judges. The judges’ decisions will be final in all respects. The winning entry will be selected using the following criteria for both the essay and photo: (1) interest and relevance of Jimmy John’s and NASCAR themes-40% (2) creativity-30% (3) uniqueness-30%. The prize winning entry will be notified by phone and/or e-mail and/or letter. 3. PRIZE The Freaky Fast Delivery of Jimmy John’s sandwiches for employees by Kevin Harvick driving a street legal replica of his #33 race car. One hour meet and greet at the company with Kevin Harvick, autographed pictures, hats and t-shirts and 2 tickets to a NASCAR race at Gateway International Raceway. There will be no cash alternative for the prize or any of its components. The date of the prize will be the week of 7/13/09 based on Kevin Harvick’s availability. If a component of the Prize becomes unavailable due to weather, time, unavailability or any other reason, then that part of the prize will not be awarded. Sponsor, at its sole discretion, may award a prize of equal or greater value if any prize becomes unavailable for any reason. Approx. Retail Value (ARV) $500.00 4. ELIGIBILITY THIS CONTEST IS OPEN ONLY TO LEGAL U.S. RESIDENTS WHO ARE 18 YEARS OF AGE OR OLDER AT TIME OF ENTRY AND WHO ARE EMPLOYEES OF A BUSINESS IN THE ST. LOUIS, MO AREA WHICH EMPLOYS AT LEAST TEN PEOPLE. Employees and their immediate families (spouses and parents, siblings and children and their spouses) of Jimmy John’s Franchise LLC (the “Sponsor”), its related entities, distributors, affiliates, subsidiaries, its advertising agencies and any other company involved with the design, production, execution or distribution of this promotion (“Sponsor and its agents”) are not eligible to enter the contest. Essays and photos submitted must be original and the sole property of the person submitting them and cannot have been previously published or have won prizes. GENERAL Entrants agree to abide by the terms of these Official Rules and by the decisions of the Judges, which are final in all matters pertaining to this Contest. All federal, state and local laws apply. All taxes on prizes are the sole responsibility of the winner. Acceptance of a prize constitutes permission for Sponsor to use winner’s name, essay and photo, voice and/or likeness for advertising purposes without additional compensation unless otherwise prohibited by law. By participating in the Contest, participants and winners release Sponsor and its parents, partners, affiliates, officers, agents, employees, advertising agencies and all others associated with the development and execution of the Contest from and against any and all liability with claims or actions of any kind whatsoever for injuries, damages or losses to persons or property which may be sustained in connection with the Contest or the receipt, ownership, or use of the prize, or while preparing for or participating in and/or traveling to or from any prize related activity. 6.
